Rental Terms and Conditions

These general rental terms regulate the conditions for renting machinery and equipment. Any deviations must be documented in writing and attached to the signed agreement.

Equipment is made available from the start date specified in the contract. Responsibility transfers to the renter upon handover and remains until the equipment is returned. Transport is at the renter’s expense and risk. If not collected within 5 days, the lessor may terminate the agreement and charge rent for the elapsed time.

The rental period begins when equipment is made available and ends when it is reported ready for return or returned. Operated machines: 5-day workweek, 1 shift, max 40 hours/week. Public holidays are not charged unless the equipment is in use. Non-operated items (e.g. pumps, containers) are charged daily. Return notifications after 09:00 incur one extra day. Weekend rental (from Friday 14:00) is charged as two days for machines ≤25 tonnes

Rent is invoiced in arrears every 14 days or monthly. Early termination requires the lessor’s written consent. Any changes or modifications are at the renter’s cost. Public holidays are not charged unless the equipment is in use.

The equipment must be operational and meet safety standards at delivery. Significant unresolved defects entitle the renter to terminate in writing and return the equipment.

Only trained and certified personnel may operate equipment. Renter is responsible for daily maintenance and for following user manuals and safety guidelines. Equipment must be protected from unauthorized use and environmental damage. No modifications without written approval. The lessor may inspect the equipment during the rental period. Defects must be reported within 2 working days.

The renter is liable for all damage during the rental. Damage must be reported immediately. Equipment must be returned in original condition, except for normal wear. Extraordinary damage must be compensated. See the insurance section for coverage.

Annual service and certification are covered by RG Norway. Daily maintenance is the renter’s responsibility and expense.

The equipment is insured through the lessor, subject to the limitations set out in these terms.

The insurance includes, among other things:

• Damage caused by fire, explosion, or lightning strike

• Theft of the equipment or damage resulting from burglary

• Damage to the equipment caused by accidents, run-offs, overturning, or vandalism

• Liability damages where the machine is used as a motor vehicle and is covered by motor liability legislation, where applicable to the equipment

The insurance does not cover:

• Damage caused by negligence, misuse, lack of maintenance, or use contrary to applicable capacity limits or intended use

• Cabin damage where the excavator’s own mechanisms are the cause of the damage, and the damage cannot be considered to have occurred due to external impact

• Damage occurring to or from cables in the air or ground, as well as water pipes

• Damage or abnormal wear resulting from use in corrosive or extraordinary environments without prior agreement

The lessee is responsible for the equipment throughout the rental period, from handover until the equipment has been returned and received by the lessor.

The lessee is responsible for any damage the equipment may cause to persons, property, or other assets during the rental period, including damage resulting from misuse, negligence, or failure to properly secure the equipment.

The lessee is required to inspect the equipment upon receipt. If no written notice of faults, defects, or damage is provided within 48 hours after receipt, the equipment is considered delivered in proper condition and without visible damage.

The equipment must only be operated by qualified personnel and in accordance with applicable laws, regulations, and current user and maintenance manuals.

In the event of damage or incidents during the rental period, the lessee must notify the lessor immediately.

The lessee must actively contribute to limiting the extent of the damage.

The damage report must be submitted to the lessor within three working days after the incident.

Failure to submit a damage report, or delayed submission, may result in the lessee being held liable for damages that would otherwise have been covered by the insurance.

The lessor is not responsible for the lessee’s direct or indirect losses resulting from operational downtime, including loss of production, delays, or consequential damages.

The lessee is required to properly secure the equipment when it is not in use. Failure to do so may result in the insurance coverage being wholly or partially void.

Theft must also be reported using the damage report form. The form includes a dedicated section for theft.

Machines up to 25 tonnes:
Insurance premium: 6% of the gross rental amount.

Deductible per incident:

Machines over 25 tonnes:
The insurance premium is included in the rental price.

The same deductibles apply as stated above.

The lessor may terminate immediately if equipment is misused, rent unpaid, or the agreement breached. Equipment will be retrieved at renter’s expense.

The renter must return equipment at own cost by rental end. The lessor may charge for necessary repairs. Equipment must be:

• Complete and clean

• Free of external damage

• Have damaged components replaced

• No need to replace working parts

It is the customer’s responsibility to delete all projects and data from the machine’s control system before return. This ensures that sensitive or confidential project information is not accessible to subsequent renters. We strongly recommend thorough data deletion to protect privacy and security.

These terms also apply to tools and accessories, even if not listed in the agreement.

Subleasing, transfer, or legal action involving the equipment is not permitted.

• Machines up to 20 tons: net 14 days.

• Machines over 20 tons: net monthly.
  Interest of 1% per started month applies after due date.

The lessor is not responsible for suitability, damages, or loss—regardless of cause. The renter is liable for all claims against the lessor and waives recourse rights.

Disputes should be resolved through negotiation or, if necessary, court proceedings unless arbitration is agreed. Norwegian law applies.

Legal venue is the lessor’s local court. The renter agrees to enforcement without lawsuit if rent is unpaid or rental ends (per Enforcement Act §13-2). The renter covers all enforcement costs.

Equipment may belong to leasing companies (LS). In that case, this is a sublease. If LS terminates its lease with the lessor, LS may terminate this rental or demand return. LS may assume lessor’s rights, but not obligations. Claims must be directed to the lessor, not LS—even in case of bankruptcy. Termination or objections toward LS are invalid without 14-day prior written notice.

The lessor is not liable for delivery delays due to uncontrollable events (weather, regulations, strikes, etc.). Rent remains due even if use is interrupted due to force majeure.
